Buyer accepts and agrees to the terms and conditions of the FCO by counter signature, affixing seal on this offer and returning the same within validity.
Seller issues Draft Contract including Draft Letter of Credit (without bank details) signed and to implement S&P agreement and Buyer fills in their (issuing & confirming) bank details, signs and returns same to Seller via email or fax. The transaction must proceed within 3 (three) working days. The Buyer will with the signed Draft Contract send a Bank Approval Letter (as per format attached) from their Bank to confirm that their Bank agrees to issue the LC as per Suppliers Bank approved format.
Once the Sellers Bank approves the Bank Payment Instrument (LC) format and accepts the Issuing / Confirming bank, the transaction will proceed further.
Seller will then issue the Original Contract with full banking details via e-mail or by fax with hard copies exchanged by DHL or equivalent courier. Buyers Bank will within 3 (three) working days from the date of signature of the Final Contract issue Proof of Funds and send it directly to the Sellers Bank via SWIFT MT 760 / 799.
Within 3 (three) working days of receipt of an acceptable POF by SWIFT, Sellers Bank will provide POP via SWIFT MT 799.
Buyers Bank will within 2 (two) working days from thereof issue Inoperative Bank Payment Instrument (LC) and send it directly to the Sellers Bank via SWIFT.
Within 5 (five) banking days of the Sellers bank receiving the Inoperative Bank Payment Instrument (LC) the Seller shall open the 2% Performance Bond in favour of the Buyer and send it by SWIFT and this shall activate the Bank Payment Instrument (LC)
In 2006 the DAP market has been relatively quiet, with US DAP prices hovering around $270 FOB. Even though the US export market is quiet the rail car market is treading higher, which relatively no change in export pricing. India appeared to be active in DAP with delvieries of DAP scheduled to arrive , previously recorded sales at 276 CFR.
